Privacy policy

General Provisions

  1. This privacy policy regulates the principles of collecting, processing and storing personal data. Personal data are collected, processed and stored by the data controller Nutikas Valik OÜ (hereinafter “data controller”).

  2. For the purposes of this privacy policy, a data subject is any customer or other natural person whose personal data are processed by the data controller.

  3. For the purposes of this privacy policy, a customer is anyone who purchases goods or services from the data controller’s website.

  4. The data controller follows the data-processing principles set out in legislation, processing personal data lawfully, fairly and securely. The data controller can demonstrate that personal data have been processed in accordance with the law.


Collection, Processing and Storage of Personal Data

  1. The personal data that the data controller collects, processes and stores are gathered electronically, mainly through the website and e-mail.

  2. By sharing their personal data, the data subject grants the data controller the right to collect, organise, use and manage—for the purposes defined in this privacy policy—the personal data that the data subject directly or indirectly provides when purchasing goods or services on the website.

  3. The data subject is responsible for ensuring that the data provided are accurate, correct and complete. Knowingly providing false information is regarded as a breach of this privacy policy. The data subject must immediately inform the data controller of any changes to the information provided.

  4. The data controller is not liable for any damage to the data subject or third parties caused by the data subject’s provision of incorrect information.


Processing of Customer Personal Data

  1. The data controller may process the following personal data of the data subject:

    • First and last name
    • Date of birth
    • Telephone number
    • E-mail address
    • Delivery address
    • Bank account number
    • Payment-card details
  2. In addition, the data controller has the right to collect information about the customer that is available in public registers.

  3. The legal basis for processing personal data derives from Article 6(1)(a), (b), (c) and (f) of the General Data Protection Regulation (GDPR): a) The data subject has given consent for their personal data to be processed for one or more specific purposes; b) Processing is necessary for the performance of a contract to which the data subject is party or in order to take steps at the data subject’s request prior to entering into a contract; c) Processing is necessary for compliance with a legal obligation to which the data controller is subject; f) Processing is necessary for the purposes of the legitimate interests pursued by the data controller or a third party, except where such interests are overridden by the interests or fundamental rights and freedoms of the data subject, especially where the data subject is a child.

  4. Processing of personal data according to purpose:

      • Maximum retention period – 7 years
    3. Purpose – Ensuring operation of the e-shop services

      • Maximum retention period – 7 years
    4. Purpose – Customer management

      • Maximum retention period – 7 years
    5. Purpose – Financial operations, accounting

      • Maximum retention period – as specified by law
    6. Purpose – Marketing

      • Maximum retention period – 7 years
  5. The data controller has the right to share customers’ personal data with third parties, such as authorised processors, accountants, transport and courier companies, and payment-service providers. The data controller is the responsible data controller. For payment processing, the data controller forwards the personal data necessary to the authorised processor LHV Pank AS.

  6. When processing and storing personal data, the data controller implements organisational and technical measures that protect personal data from accidental or unlawful destruction, alteration, disclosure or any other unlawful processing.

  7. The data controller retains personal data depending on the purpose of processing, but no longer than 7 years.


Rights of the Data Subject

  1. The data subject has the right to access their personal data and to review them.

  2. The data subject has the right to receive information about the processing of their personal data.

  3. The data subject has the right to amend or correct inaccurate data.

  4. If the data controller processes personal data based on the data subject’s consent, the data subject has the right to withdraw that consent at any time.

  6. To protect their rights, the data subject may file a complaint with the Data Protection Inspectorate.


Final Provisions

  1. These data-protection terms have been prepared in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council (General Data Protection Regulation), the Personal Data Protection Act of the Republic of Estonia, and other Estonian and European Union legislation.

  2. The data controller has the right to amend the data-protection terms in whole or in part, notifying data subjects of changes via the website www.telo24.ee.
